Petition to Rezone

  • A rezone petition is a request to change the zoning district designation for a particular parcel or to change the zoning district boundaries.  Generally, Petitions to Rezone are initiated by a property owner.  Petitions to Rezone must be approved by the Dane County Zoning and Natural Resources (ZNR) Committee, the County Board of Supervisors, and County Executive and the Town of Pleasant Springs.
    • NOTE: The Town of Pleasant Springs prefers  that you obtain preliminary approval of your Petition to Rezone from the Town Board and the Town Plan Commission before you submit it an application to Dane County.
  • When your proposed use or structure is not permitted within an existing zoning district, you may petition to change the zoning district designation or the zoning district boundaries.

  • If you are applying for a Zoning Permit and Zoning Division staff determine that a Petition to Rezone is required for your particular use or structure, you will need to file a Petition to Rezone before you proceed with the Zoning Permit application.

  • Where can I apply?

    • You may go to the Town Hall and request a Town Rezone application from the Town Clerk. (See information at the bottom of the page for address, phone number and hours).

    • The County Rezone application may be obtained from the Dane County Department of Planning and Development-Zoning Division, Room 116 of the City County Building.

  • What happens once I complete my applications?

    • When your application is submitted to the Town you will be given a date at which time you will appear before the Plan Commission to explain your request.  The Plan Commission votes on whether to grant preliminary approval, or deny your petition.  The Plan Commission is advisory to the Town Board.

    • You will then appear at the next scheduled Town Board meeting to explain your request, and at that time the Board votes to grant preliminary approval, or to deny the petition.  This is vote that determines if your rezone can proceed through the county process.  Once you have filed the County application, the Zoning Division staff will schedule and publish legal notices for a public hearing before the ZNR Committee, as required by Wisconsin State law.  The notice announces an intention to rezone at a specific location.  It is published in the Wisconsin State Journal one and two weeks before the public hearing.

    • Generally the ZNR committee takes action Petitions to Rezone at the public hearing.  The Committee will not act on any Petition to Rezone with out receiving a Town Action Report prior to the Public Hearing.

      • Note: The Town Of Pleasant Springs does not submit the Town Action report before the Public Hearing, therefore the ZNR Committee will submit the Town Action Report and if favorable, the Zoning Petition will be approved at ZNR Committee Work Meeting at a later date.
